DEFINITIONS AND PREMISES

Where mentioned in the Contract, the terms below shall have the following meaning:

Landlord
The Landlord, Italy Will s.r.l., identified in the appropriate page Legal Information, may also be referred to in this document with the expressions “Italy Will srl”, “We”, “the Company”, “Supplier”.

Tenant
The natural or legal person who receives from the Landlord the right to use and enjoy the property or room(s) that are the subject of this contract.
The Tenant may also be referred to with the expressions “Client” or “Visitor” or “Guest”.

Booking
Acceptance of the contractual proposal, also called commercial offer, relating to the property or room(s) formulated by the Landlord via email, website, tourist portals (Online Travel Agencies) and accepted by the Tenant.

Property
Real estate unit located at the address indicated in the Booking, consisting of the rooms indicated in the Booking, fully furnished and equipped with the accessories indicated in the Booking.
The Property may also be indicated with the expressions "Accommodation".

Room/Rooms
Bedroom/rooms with bathroom/s indicated in the Booking, fully furnished and equipped with the accessories indicated in the Booking.

Maximum Persons
Maximum number of people that can be hosted by the Tenant, indicated in the booking confirmation.

Start Date Lease
Start date of the rental period, as reported in the Booking.

Lease End Date
Date of end of the rental period, as reported in the Reservation.

Advance Payment
It is the sum paid by the Tenant to the Landlord as an advance on the Total Rent. The Advance Payment may also be indicated with the expressions "Deposit".

Security Deposit
It is the sum of money, paid by the Tenant to the Landlord or the details of a credit card, different and in addition to the Rent, to guarantee the fulfillment of all the obligations imposed on the Tenant and whose discipline is set out in art.11, L. 392/78.

Total Rent
It is the sum paid by the Tenant to the Landlord for the rental period from the Rental Start Date to the Rental End Date, in relation to the booked rate.
The Total Rent may also be indicated with the expressions “Total Amount” or “Total Amount” or “Rent” or “Rate” or “Daily Rate”.

Balance
It is the sum paid by the Tenant to the Landlord resulting from the subtraction of the Advance Payment from the Total Rent.

Check-in Time
Time on the Rental Start Date at which the Tenant can take possession of the property or room(s). The check-in time is established between 3:30 pm and 7:00 pm, unless otherwise indicated in the Booking.

Check-out Time
Time on the Lease End Date at which the Tenant must vacate the property or room(s). The check-out time is set at 10:00, unless otherwise specified in the Booking.

Acceptance Date
Date on which the Tenant accepts and signs this Agreement, also in digital form.

SUBJECT OF THE CONTRACT

With this Contract, the Lessor grants the Tenant the exclusive lease for tourist use, who accepts the property or room(s) in the same state of fact and law in which it is located, in accordance with Italian law no. 431, art. 1, paragraph 2, letter c) of 9 December 1998.

DURATION AND FEE

The Tenant undertakes to host no more than the Maximum Persons, including himself, for the period, in any case not exceeding thirty days, from the Lease Start Date to the Lease End Date, when the lease referred to in this contract will cease without the need for any cancellation, for the agreed Total Rent.

PAYMENT OF AMOUNTS

Payment of the Fee in full or through any Advances with Balance of the Fee occurs as reported in the Reservation.

DELIVERY OF KEYS

The delivery of the entrance keys to the Tenant, even in the form of an access code, takes place as reported in the Reservation and communicated to the Tenant in person or by email or by text message.

The return of the same to the Lessor by the Tenant takes place as reported in the Reservation and communicated to the Tenant in person or by email or by text message.

The delivery of the keys will take place only after payment of all the sums due.

In the event that the Tenant does not collect the keys in the manner and within the timeframes established by the Lessor, the Lessor may withdraw from the contract, retaining any Security Deposit in addition to the entire agreed Rent.

POSSESSION OF ACCOMMODATION

The Tenant may take possession of the property or room(s) at the Check-in Time on the Rental Start Date and must vacate it by the Check-out Time on the Rental End Date.

In the event of non-compliance with the Check-in and Check-out time rules, penalties will be applied as indicated in the “Table of Penalties”.

PROHIBITIONS ON SUBLETTING, LOAN AND TRANSFER

Subletting, loaning or transferring the use of the property to any other title to third parties, in whole or in part by the Tenant, is prohibited, under penalty of termination of the contract.

EARLY RETURN OF THE PROPERTY

In the event of early return of the keys by the Tenant, with respect to the expiry date of the lease, the Rent already paid will not be refunded.

HOSPITALITY RULES

Hosting in the property or in the room(s), a number of people greater than the agreed number, Maximum Persons, as well as any substitution of person by the Tenant during the rental period, will result in the termination of the contract, pursuant to art. 1456 of the civil code and the obligation on the part of the Tenant to pay the Lessor, a sum equal to the amount of the entire agreed Rent, as a penalty pursuant to art. 1382 of the civil code also withholding for this purpose any Security Deposit.

  • The Tenant and other guests with him are required not to occupy the common area with illegal parking;
  • The Tenant and other guests with him if they own animals must ensure that they do not disturb. Outside the property or in the common areas, dogs must be kept on a leash. If animals should dirty the common areas, the Tenant or other guests with him are required to clean it immediately;
  • The Tenant and the other guests with him are required to behave as polite and civil people, observing the rules of good neighborliness with mutual tolerance and respect, avoiding any reason for annoyance or disturbance to others. Above all, parents must supervise their children so that they do not make a racket or cause damage or disturbance, prohibiting them from remaining in the common areas from 12:00 to 16:00 and from 23:00 to 8:00;
  • The Tenant and other guests with him are responsible for the safety of their children at all times;
  • The Tenant and other guests with him must be careful when children are on the terrace, balcony or in any area not suitable for children.

The Driver and other guests with him are prohibited from:

  • Smoking inside the property or in the room(s) or in the common areas, including electronic or vapor cigarettes;
  • Throwing cigarette butts on the floor. Cigarette butts must be thrown in the designated ashtrays;
  • Allowing access to unregistered guests or visitors;
  • Eating or drinking in the bedrooms, bathrooms and hallways;
  • Organizing parties or events without prior authorization from Italy Will;
  • Photographing or filming for advertising or public purposes unless explicitly authorized by Italy Will;
  • Picking up bulky material in common areas, leaving bicycles, scooters or other vehicles leaning against walls;
  • Throwing objects and polluting substances into rainwater drains and manholes;
  • Drying out linen, clothes and anything else in an overly visible manner;
  • Keeping flammable, explosive, corrosive material or illegal substances in the premises;
  • Pouring any liquid other than water into the sewers;
  • Washing cars, motorbikes, vehicles in general at all times and in every place of the Complex;
  • Leaving the entrance gates of the property open;
  • Use the premises for purposes that are not compatible with morality and good manners;
  • Wash clothes, dresses or other linens in the bathroom sinks and/or shower and/or bathtub;
  • Occupy the parking space not assigned to the Tenant;
  • .
  • Access the areas beyond the fences within the property are considered private and off-limits, as are all locked accesses or those indicating the prohibition of entry or private use;
  • Disturb the neighborhood with loud noises or annoying noises.

The Tenant and other guests with him may be removed if during their stay they behave in a manner contrary to common rules of civil education and disrespectful of the articles reported in this contract. Immediate removal will result in the loss by the Tenant of the amounts already paid, without prejudice to further compensation for damages.

ROOM CHANGES

The Tenant is prohibited from making any kind of changes to the property or to the room(s) and to the furnishings, from colouring and painting as well as from drilling holes in walls and attaching nails, from moving furniture and from making any changes, under penalty of immediate termination of the Contract.

SUPPLIES AND SERVICES

The Landlord grants the Tenant only the enjoyment of the property or room(s), including furnishings and furniture. The provision by the Landlord of meals and drinks, surveillance services, custody, cleaning, tidying up and maintenance of the premises and furnishings, all of which are provided for directly by the Tenant, are expressly excluded.

Bed linen and bathroom linen changes are not provided during weekly stays, unless expressly requested by the guest following the fact that he/she has stained them. In this case, a penalty will be applied as indicated in the “Table of penalties”.

DEFECTS PRESENT

The Tenant must notify the Landlord of any defects in the room(s) and furniture within one hour of receiving the keys.

For any complaint, the Tenant must contact the Landlord (or a person designated by the Landlord) who will do his best to resolve the report.

Any complaints about facts or events that may cause significant damage or in any case may induce the Tenant to request compensation for the damage suffered, must be communicated in writing and delivered to the Landlord.

Complaints submitted after departure and not previously reported in writing will not be accepted in any way.

In the event of a complaint, the Tenant undertakes to grant the Landlord the time necessary to resolve it. Under no circumstances is the Tenant permitted to make repairs or modifications, under penalty of immediate termination of the Contract.

ACCESS TO THE ROOMS

The Landlord reserves the right to access the property or the rented room(s) to carry out essential maintenance operations or to close windows due to the imminent passage of a disturbance or imminent danger of another kind.

PETS ALLOWED

The Lessor has the right to grant, even for a fee, the Tenant the presence or absence of any small animals of the Tenant, during the period of stay, as reported in the Reservation.

SERVICE CHARGES

Except as indicated in the Reservation, in relation to the reserved rate, the expenses relating to the supply of electricity, gas and water, condominium fees, waste removal tax and maintenance costs of the rooms and the Property including small maintenance costs, will remain the responsibility of the Lessor.

In addition to the agreed cost of the stay, the guest will have to pay, if the Municipality where the property is located provides for it, the daily municipal tourist tax of the value indicated on the website of the municipality and in any case as indicated in the Reservation.

DAMAGES

The Tenant undertakes (art. 1590 c.c.) to return the property or the rented room(s) in the same condition in which he/she received them, always excepting wear and tear, under penalty of compensation for damage as indicated in the “Table of Penalties”.

The costs necessary for the repair of any damage to the property or room(s) and/or furnishings, damaged by the Tenant, will be deducted from the amount that the Tenant will deliver as a deposit at the time of return.

The Tenant is in any case responsible for any damage caused that exceeds the amount of the Security Deposit.

CLEANING

The Tenant undertakes to leave the rooms clean and tidy and to deposit waste in the appropriate containers in the rooms.

The Tenant undertakes to leave the kitchen tidy with dishes and pots washed as they are not included in the general cleaning costs. In case of non-compliance, a penalty will be applied as indicated in the “Table of penalties”.

It is not necessary for the Tenant to carry out a thorough cleaning, but in the event that the room(s) are found to be untidy and require thorough cleaning by the Landlord, an additional cost for thorough cleaning will be charged to the Tenant, as indicated in the “Table of penalties”.

SURVEILLANCE CAMERAS

For security reasons, the house is equipped with a CCTV system outside, while there are no cameras inside the rooms and facilities to protect your privacy.

PERSONAL DATA

The Landlord and the Tenant mutually authorize each other to communicate their personal data to third parties in relation to obligations connected with the rental agreement (Legislative Decree 196/03).

EXTENSIONS, MODIFICATIONS AND/OR ADDITIONS TO THE CONTRACT

Any modification to this Agreement may not take place, and may not be proved, except by written instrument.

CONTRACT REGISTRATION

Since this is a rental contract with a duration not exceeding thirty days, it is subject to registration only in the event of use pursuant to Art. 2-bis of Annex A – Tariff, Part Two, to the Presidential Decree of 26 April 1986 n. 131.

LEGAL REFERENCES

For anything not expressly provided for in this contract, the parties mutually acknowledge that this contract is exclusively governed by the provisions of the civil code and the current regional law on the matter, as it is a lease stipulated to satisfy housing needs for tourist purposes.

DISPUTE RESOLUTION CLAUSE

For any dispute concerning the execution of this contract, the parties agree to the exclusive jurisdiction of the Court of Padua.
